Anchorages


    Foreword



 

As a contribution to the second Anchorage Forum to be organised by the DIRM-MED at the Palais du Pharo, Marseille, on 0ctober 18th 2022, AIYA (Antibes International Yachting Academy) wishes to present a report on the impact of the 12th October law. Two years after this law came into force, what is the situation at present?



 Reminder: 


 


On October 12th, 2020, Vice-Admiral Laurent Isnard, the maritime prefect for the mediterranean seaboard, signed the first executive orders regulating the anchoring of vessels of 20 meters LOA and above along the coastline of the Alpes-Maritimes. These orders identified prohibited mooring zones, which had been defined after a consultation process involving the relevant maritime partners (local and national authorities, councils, ports, environmental associations, pilots, fishermen, amateur and professional yachtsmen).


.All through the autumn, a series of similar executive orders, along the same lines, were issued for other coastal departments, in keeping with the 123/2019 framework order. The promulgation of this law raised many concerns amongst international yachting professionals, particularly as regards the future of their activities.

Questions put to yacht captains:

 

So as to measure the impact of this law, two years after coming into force, AIYA put the following six questions to the captains:


1. Has the anchorage law been, or is it still, a factor in your planning of where to go?


2. What difficulties has this anchorage law caused you day-to-day?



3. Where would you like to see ecological anchorage solutions to better satisfy your clients? Please indicate the name of the anchorage or of the navigation area


4. - For many of you, your clients want to be able to see the seabed when they go swimming, and dislike having to swim in waters 30 meters deep. What depth would be appropriate for your anchorages? Please give a max-min range of depths.


5. In relation to the size of your vessel, are there enough zones for dynamic positioning, and are they adapted to the needs of your clients?


6. What efforts, in terms of protection of the environment, are you willing to make in order to be able to anchor in a ZMEL (restricted anchorage zone)?

On the other: your responses will be processed according to article 11-4 of AIYA’s statutes, namely


"11-4 : Duty of confidentiality on the part of the administrative council"


Members of the Administrative Council are duty bound to maintain discretion. This obligation applies to any information objectively presenting a confidential character (financial documents, strategic information, identities and activities of individuals).


In such cases, the purpose is to protect the right to privacy and to prohibit the dissemination of information which, for various reasons, should not become public. Persons finding themselves forced to remain silent are responding to a duty of discretion.
